What does the birth certificate say? If you dad's name is not on it, I don't think so.
How old are you? If you're under 18, it is going to depend on state law. This is not a simple question you are asking.

If you parents weren't married, you cannot just go live with your Dad. He could be charged with kidnapping. Talk to your mother about allowing you to live with your Dad temporarily. Try it out before you commit. The grass always looks greener on the other side of the fence. It rarely is.
