do we haft to go to court for my dad to get custody or can i just go with my dad and not come back??

You didn't say why you want to leave your Mom and go live with your Dad. Check with your Dad, don't surprise him by showing up on his doorstep. He may not be prepared to have you move in.

Maybe it's not as bad as you think, 13 is a hard age, and things get better fairly rapidly as you grow up. Talk to your Mom if you can.

Depends on the state you are in Dearie! The state I live in Yes, but it's different from state to state. Now if you go to court generally if you are put on the stand the Judge will rule in favor of the child. If you just leave with your dad & not come back your Mom can file kidnapping charges. they MAY NOT stick but it ruins your chances of the Judge hearing you in court because definately after that there will be a court hearing for your custody. If your dad Can't afford an attorney there are Public Aid attorneys that will help.

If your parents are still legally married and you just happen to live with your mother, you can go live with your dad any time you want, if he'll have you. Just remember it may break your mother's heart and the grass always looks greener on the other side. At 13 you probably don't like your mother's rules. Your dad, if he's a good one, should set the same rules...maybe even stricter. If he doesn't, he doesn't love you as much. The parent with whom a child lives must set rules and guidelines for you until you are mature enough to make good choices on your own...by the time you are in your 20s. Think about this carefully.

If your mother has custody now then your father would have to take her to court to get custody. If you leave with him and don't go back, that is considered kidnapping and your father will be in big trouble. Go to court, through the legal system. Do it the right way.

Talk it over with Mom and Dad you are older enough to decide who you want to stay with.If Mom want let you then you need to go to court so Dad can get custody of you, and most likely the judge will ask you who do you wish to live.

First of all. Tell your mother and your father that you want to live with your dad and see where it goes from there. After all they aren't divorced. you can go live with your dad.. and she will have to take it to court to get you back when she files for divorce from him.
don't take this for granted you don't say what state you are in.. ask a lawyer.. they have lawyers that will answer questions for free. best to get some ones advice on what to do as to not get your dad in trouble.
but talk to your parents first and see if they can make a decision about what you want for your happiness.

It depends on where you live- you can try talking to your counsellor at school.. to get the ball rolling- More or less these days a child over 12 has a mind of his/her own and can choose- BUT remember the decision would have to be in your best interests

I think you would need to have some kind of papers especially if you have been living with your mom for the majority of the time.It sound like you are having a hard time, have you asked your father what he thinks? Does your mom know you are not happy?

You gotta go to court with your dad and tell the judge that you want to stay with him. Make sure you are old enough legally to decide where you want to live. good luck

Calvin's mom is an nominal Christian...I HATE Christians like that. they want to be fed to the damn lions like contained in the Roman situations...excuse my evilness. besides, F-ck them, your son needs your help right this moment. i do not comprehend the way it feels to lose a figure and be remoted by technique of that figure's buddy. yet, you want to teach your son, you'd be both a father and mom confirm to him. All you are able to do at this second is enable him to grieve and be at his part. do not problem attempting to get that nominal Christian interest, it may bring about a pair relations drama.
