1st is a B misdemeanor
2nd is an A misdemeanor
3rd or more is a felony

in Massachusetts a DWI is a misdemeanor..until your 4th...once you go over 3 it's a felony.

It depends if it was beer or wine that got you a DWI.
If it were street drugs that is a felony.

you must have done more than got drunk and drove to get 4 months in prison?????? you can check with your local law enforcment people and they will splain it to you just as clear as mud.

Your attorney should have advised you of the status of your conviction or you should have paperwork with your conviction status on it.
