I don't know a lot about penguins, except that they wobble about a lot ! But I think it would be frowned upon to have a couple in your back yard, even if you had a pool.
In the UK you could 'adopt' almost any kind of animal, maybe there is a similar scheme in the US? You wouldnt be able to keep it in your own pool, but for a small donation you would get regular reports and photos of its well being, why not look into that?

If this is a serious question...and I'll treat it like it is...
Penquins do not make good pets. They are incredibly social animals living in huge colonies of many hundreds to thousands of birds. The care requirements are very specialized. Outside of the challenges needed to care for one of the many species of penguin...the ethics of owning one brings up a whole other set of issues.

They are horrendously difficult to keep, expensive to feed, and cleaning up after them would be absolutely no fun. For the most part, their poop has the consistency of a milk shake.
Yes they are "cute"..."adorable" even, but you smply aren't being realistic.

You cannot own a wild bird as a pet. Birds are protected by law. Enjoy them out in nature as they are intended to be enjoyed. Or go see some at a zoo.

im not sure if u can own a penguin,u might want to check with a zoo.but i doubt it.
