To Coragryph, I just want to say that this question is not talking about businessmen who are legitimately and legally in the USA - this is regards to illegal immigrants, which is a completely different thing. Yes, I believe anyone who is legitimately in the USA, beit as a visitor or legal immigrant or anyone in the USA legally, yes, they should be able to get punitive damages in a US courtroom. However, illegal immigrants in the USA should NOT be able to even sue or be in a US courtroom unless it is because they are being charged and/or deported!

It's a violation of equal protection. Immigration status is an exclusively federal issue. States cannot discriminate based on that status for neutral laws.
Also, consider the affect that has. Someone who is a businessman from another country, or a foreign visitor who is injured while travelling in the US. They are not US citizens or nationals. Under that law, they are prohibited from recovering such damages in US courts, which is a due process violation.
In the rampant fanatic fervor to deal with the perceived immigration problem, people really need to look at the laws currently in place, and stop reacting blindly with no regard for the consequences of their actions.
