I have a 4 year old daughter who has always been around her father and his family. He has visitation everyother weekend with her and has had that since she was 8 months old. When she is home and her fathers name is spoken she gets upset and says that its not his name its daddy and that it is ugly to say his name and she gets hit in the mouth...She has called crying begging to come home but his family will not let her. What do I need to do to get something done about this?

Our case is under investigation. When you ask my daughter what happens when she says her daddys name she will smack you in the mouth and says that ugly its daddy....I am really scared and hurt because she is only 4 years old and is having to be made go stay. During the day she is fine but at night she calls crying wanting to come home and wants me to come get her. I have it recorded and everything but I need to know if I need more to stop this visitation in front of a judge.I live in VIRGINIA so I have to go by this law. PLEASE HELP ME.

His family refers to his mother, step father, brother, and sister, basically his family as whole. He has no girlfriend or other wife. He smacks her in the mouth for saying his name instead of daddy.

I think you need to stop allowing him to see her ASAP. What he is doing is a child abuse and if reported he can go to jail for it.
I really suggest you not allow him near your child and you contact the police about this. His family has no say in where the child stays, if she wants to come home then she wants to come home, simple as that. You can not force a child to stay where it does not want to and by letting her go off with him you are letting the abuse go on and if you continue to let it go on and finally decide a few weeks or months from now to report it then your going to have a much harder case because people are going to be asking why you let the abuse go on for so long knowing it was happening.
None has a right putting thier hands on a child and this guy is a sorry excuse for a dad and has no right to call himself one. I have a 2 year old and if his father ever put his hands on him I would beat the holy hell out of him and be pressing charges.
Right now it is just a slap in the face but what happens when it turns into a belt or a bang into the wall?? Stop this now and save your daughter from this abuse.

okay so you aren't being very clear about what she is doing.....she says that she gets hit in the mouth for saying his name?????? Have you ever thought that maybe she is just having separation anxiety from you(the calling at night when she is ALSO going to be really tired and the most susceptible to all those feelings). Take her to see a counselor. Anything she says to the counseler(especially about an adult hitting her) will be documented and you can use that in court. Your word will not be enough to get visitation stopped. You will need a 3rd party involved.

Sorry if I sound harsh, it's only in the hopes of getting you to move quickly before those smacks in your daughter's mouth become far worse.......GET OFF YOUR BUTT NOW, CALL THE POLICE, HAVE YOUR DAUGHTER TELL THEM WHAT IS HAPPENING AND THEN TAKE HIS SORRY *** BACK TO COURT AND HAVE ALL HIS PARENTAL RIGHTS REMOVED! The next time she calls you, GO GET HER and take her straight to a hospital, they'll help you press charges against her father and don't let him or his family stop you from taking her, call the police to meet you if necessary. If you don't act quickly and it's learned that you knew of this abuse, YOU'LL lose her too, to a cold and cruel system. Good Luck & God Bless.

You should get a lawyer, no child should be hit, let alone in the mouth. It is not up to his family if she comes home early or not. Can't her daddy make the decision? If it is the daddy hitting her in the mouth or other places, she shouldn't go!!!

Go back to court and reopen the custody question. Ask the judge to talk to the child. This sounds like child abuse. You could also call child protective services.

btw she gets HIT for calling her daddy daddy? stupid reason for hitting your child. have you tried getting a hold of child services if you cant keep her safe?
