My brother was riding his bus and sitting next to this kid who he was joking around with. My little brother who is just 5ft and 58lbs, playfully punched this 8th grader in the arm. The 8th grader then proceded to stand up and kick my brother to the floor where he recieved: a large bump on his head from hitting the floor, several cuts on his face where he was kicked, and a broken wrist. I want to hurt this kid, but I dont want to go to jail. I would press charges but because it happened on the bus, its in the school district's authority. Unfortunatly I live in an area with a Zero Tolerance policy, thus because my brother jokingly hit this kid in the shoulder who he was playing around with he would be subject to the same punishment as this sadist who would hurt someone two years his junior so badly. I want to know, should I take the punishment of the law and teach this kid a lesson, should I go to court, or should I just let the whole issue drop. Keep in mind that I am 16 and a minor.

My parents already reported it, but are now seriously considering dropping the charges because as I said, we live in a zero tolerance area, and my brother would actually be blamed for "starting" the fight.

Have your parents take it up with the school principal.

It's under the school's jurisdiction, they should expel the kid. If they don't, then you can explore other avenues to make sure this kid gets punished for what he did.

Don't take it upon yourself, though.

All this happening, and what the heck was the bus driver doing?? Call the Police and make a report, than go for the school. Make sure the bus driver is also brought up! The law states, once someone is down, the fight is OVER!!! Your brother is young, and was only joking around, a little different from this bully kicking him and BRAKING HIS WRIST!!!!!!!! I am a mother, and I tell ya, I hate to sound immature, but I'd be kicking that kids mom's as*!! Make sure they also pay for the medical bills..If it were reversed, your parents would never stop hearing about it. When it comes to OUR kids, it's WAR!!!! Well, you got the main idea!!! Your a good brother, and glad to hear your right there for him! But we pay BIG taxes for the COPS to take care of things like this! The kid needs this too, might save him from prison later!!!

Well, you should never really playfully punch a person because in this generation we're in, people can take things comepletely the opposite of how we really meant them to be.
But the 8th grader shouldn't have beaten up the 6th grader. That is wrong and the 8th grader needs to learn how to respect people (especially the younger kids) and he can actually get suspended or expelled from school. As the older brother, you need to show your brother how to defend himself and how he should be careful about who playfully punches.
You can press charges on the guy if he made your brother bleed and left some scars.

I wouldnt do anything. First of all, its your brothers word against the other guy. You are not in the picture. If there will be punishments doled out when you hurt this kid who beat him, those two would have better explanations than you, since you have pure revenge for motive. Thats bad news. If found guilty you will be punished more severely.
The best way to deal with it is to complain to the bus company. The driver should have been able to stop the beating of a younger smaller person.
There should be a bit of a guarranty that a bus ride will not result in broken wrist, etc,

I suggest you talk to the 8th grader. Remember they are always in awe of someone older and will listen to you. Be firm, and explain that is this behavior ever happens to your brother again you will take care of it. Use a little fear tactic. Of course, you would never hit him but dont let him know that. If it happens again turn him in to the office. If he hit your brother so hard it left marks he is a bully and needs to be in trouble.
And if you decide to report the kid I am sure he will be in much worse trouble since he is older and should know better. Dont wait to long to report it. They dont take you seriously if too much time goes by. How about your parents? Will they go and report it too.

He should not get away with this as he may hurt someone else. Keep your brother away from him even if someone must drive him to school. Good Luck

Because of zero tolerance, there is no flexiblity. Both boys are in trouble. Your parents need to handle this. You are not a parent.
Sure, anyone would like to get even with people that hurt us, and others we love. But I have found out that when people hurt you - "what goes around, comes around." That is, the boy who hit your brother, has no control over his anger. Eventually (and it will happen) he will get into serious trouble and find a lot of police and legal problems coming down on him. Just stand back and wait.
Revenge is sweet.

take the issue to the school. they will not see it as your brother as "asking for it" because he hit the other guy first. also, if it were my brother, i would find the kid, back him into a corner and tell him that if he even looks at your brother the wrong way again, that he doesn't even want to know what id going to happen to him. there is nothing the courts can do to you really since you are a minor also.

well if you can get get the kid to hit you first by all means go for it. No one messes like that with little kids. But if you can't talk your parents into taking him to court you will probably win. but if you don't want such a hassle pay another tougher 8th grader to beat up the dude and to tell him to leave your brother alone or he'll suffer a very excruciating pain.

Press charges anyways.Your brother only playfully punched him, and hes 2 YEARS YOUNGER. How bad could that hurt the 8th grader? Unless he's feminent if thats how you spell it.If he only punched him once, why did he have to beat him up that bad? Why am i asking you the questions? lol well i just think you should press charges.

Don't beat the kid up. You'll end up with a juvenile record. Bad idea. However, maybe you could "talk to him" and convince him that you will kick his a$$ if he ever harms your brother again.
