I have a temporary Order of Protection issued against an ex-girfriend in New York State. No children, never lived together, etc. She called me on the telephone last nite. I dialed 911 and filled out a report at the scene. Today the police called me to say that they were going to arrest her. I have a pending aggravated harassment case against her which is the reason I was granted the Order. What is the punishment, if any, for a first violation of an Order of Protection. There has been no violence.

Violation of a court order makes the person subject to charges of contempt of court, in addition to any other violations.

What the court chooses to impose as the penalties for contempt can vary, based on how serious the violation was, what happened, and how likely the court is to think it might happen again. It's pretty much all up to the judge.

my friend has a restraining order against him by his wife, they have been separated 2yrs. he already had violated the restraining order x1 by a verbal altercation in the bank parking lot this was dec 2014 a few day before the 1st restraining order was to be up. the judge gave another restraining order on $2500 fine. today he was getting oil change at jiffy lube next to his house which his wife still resides in, and a neighbor saw him in the parking lot, called the police. he was arrested again being charged with violation of restraining order. he did not go onto the property or near the house, what will likely happen to him in court?
