Ok how do I get emancipated in arkansas? Im 16 my mom moved to north dakota and left me here to live with my older sister(25) and my dad lives in tulsa and he is now trying to get custody of me but I really dont want to live with him!!!! He has a wife and 2 daughters and they are going to live in Illonoise in December! I really want to stay here with my friends and I got good grades in school and im in softball and track. He doesnt really want me to live with him, he just dosent want to have to pay me child support and I know that bcuz when we all lived together(me, him and my mom) in colorado a few years ago he divorced my mom and got me and here bus tickets to arkansas for CHRISTMAS!!! and he never calls me not even on my 16th birthday! Also my mom said she would let me get emancipated so do u guys have any suggestions???

You need to be prepared to pay a lawyer a lot of money and be able to support yourself and still go to school.
I'm so sorry, Sweetie, but a lot of teens have to live with one parent or the other, and have to move to a different state away from friends.
And there's lots of kids who live with step parents & step siblings they don't get along with. It's not a happy situation, but it's not the end of the world.
Just try to have a good attitude about it & make the best you can of the situation.

JD, everyone is talking lawyer. It's not that intense! Just get a hold of a social worker in your area. That's their job. They deal with this stuff, and things much more intense than this. You may not have to put out a thin dime for anything! However, you want emancipation, you should understand the term! You must be able to fend for yourself or at least make it seem that way. I'm guessing your sister doesn't want to let you go and you want to stay with her. This would help considerably if you can say you assist in the household. A job is a must. You won't get emancipation without it. Doesn't have to be something grown up. Maybe work at a theater at night is all. Cashier at a gas station. Whatever. I'm guessing that you are mature enough to know your situation with your dad is unresolvable. Just remember, once emancipated there is not going to be anymore child support! Your saying your not a child, remember!

It may not be emancipation you want but your sister getting gardenship of you. That might be easier for your. I think no matter what your father has to pay child support until you are 18 regardless of you being emancipated or not.

Since you are living with your sister a judge may see it as a good thing that you stay with her. Maybe cause you have not lived with your father in a while or that you want to stay in the school that you are in.

Legally your mother could not have left you with your sister with out the courts knowing about it since you are still a minor and your father lives in a different state.

As you are no longer a child and seem to be well adjusted and established in your current situation I see no court willing to jeopardize the fact. Your father has no grounds to gain custody over your mother. At your age especially the courts will go with your wishes as far as where you live etc. The courts would ? why your father was not interested in trying for custody when you were a child? Why the sudden interest etc.?? How close are you to 17, then you are free to move out on your own if you so wish, but I think you intend to finish school etc. while staying at your sisters, if all is well the courts will not interfere they know how quickly you could rebel and cause nothing but problems to include dropping out of school etc. Simply tell your father you are not moving you are doing well just as you are. Your mother insured you had a place to live and everything was fine before moving which was proper for her to do before moving.

Be careful what you ask for; you just might get it. Having you older sister as your guardian is a much better answer. What ever you do, don't get married just to get away from your parents, at least until you are 18. Do what you can to stay with your sister. Make sure your dad keep current with the child support. Make sure the payments actually go to your support.

First young lady, please learn how to spell Illinois.
Now to your problem.
Is your situation with your father that bad that you cannot make the effort to live with him ? Have you really tried it.
You will not really know unless you try it. He may just really want you with out all the garbage you think is going to happen.
Why did you not stay with your mother then is my question.

No one here is really qualified to give you legal advice, Well lets say good legal advice.
You will have to have a good lawyer that knows your states legal
rights for this. It Will mean going to court and could end up a long dragged out deal.
If this is what you wish, also have to be prepared to accept responsibility for what you do and your actions.
are you ready for adult responsibility? It is not something to take lightly. You need to really give this all serious thought and you do need good legal representation .
I am sure you will get some quick witty answers and they could lead you down the wrong path, So, see a good attorney.

Go to your local court house, and they should direct you in the right direction. Because of your age, you should receive free attorney's by legal aid. Contact them, and they should see about helping you too.

Once you get emancipated, keep on the courts to keep on your father to have to continue on your support too. He has the legal repsonsibility to do so until you 18 or graduated from High school.

you must get a job get your self a home on your own , when a child is emancipated you are in effect saying you can care for your self
