I know someone that got herself mixed up in some nasty stuff. She worked at K-Mart and she allowed her family to go shopping and only charged them like $10. They would walk out with like $700 worth of merchandise at a time and go back several times a week. Well she was naturally caught and arrested for the crime.
She was placed on probation for 2 years and ordered to pay a fine. During her probation period she went to another store and was caught stealing once again. She was arrested and her probation was revoked. However when she went back to court the judge extended her probation and warned her that if she was caught stealing again he would lock her up for good.
It depends on the situation. Her situation was very ext ream and she is a career shoplifter.

It will depend on your individual state laws. Make sure you have the cash on you to pay for the item- otherwise they can prove intent and call it burglary. Make sure you have nothing on you (scissors, knife, etc) that can be called a tool- the same applies.
Make sure you can prove it was an 'accident' 'forgetfulness' or 'whim'.
And just for the sake of propriety, I'll make the suggestion that you see some sort of counselor and try to stop.....whatever. Come check out the group.

Under California's 3-strikes law, life. Or 50 years, which is the same thing. See Lockyer v. Andrade: http://supreme.justia.com/us/538/63/case.html

In Cook County, IL you don't go to jail for shoplifting, unless it's your 100th time. Otherwise like all other crimes they just slap you on your wrist and let you go commit more crime.

Depends on whether this is your first offense, and the value of the stolen merchandise. If it is over a certain amount, then it becomes a felony, instead of a misdemeanor.
