Now in Florida, got drunk driving, did some jail time, out on probation... Is it legal to leave the state of Florida permenatly while on probation. Can terms of probation be transfered to another state? Before I hear a bunch of "you shouldn't be driving drunk anyway" answers, please know that this is not my situation, it's my brother... and yes, he needs help..

Where does your brother want to move to, and why does he want to move to that place? Does he have any job prospects in the different state, or does he have immediate family in that state? (Immediate family would be parents, siblings, spouse, or children.)

If he has immediate family in the other state, there is a presumptive approval of the transfer of probation. Your brother needs to speak to his probation officer about transferring, and has to fill out the paperwork. He will have to pay a fee, which is currently $75, to the Interstate Compact of Florida and be up to date on all his costs and fees.

If he wants to move but doesn't have immediate family in the other state, he can apply for transfer of probation, but the receiving state has the right to turn down the transfer.

These rules are the same for all states. I'm an Indiana Probation Officer, and have some clients who were able to transfer, and some who were denied transfer.

Judge has the discretion to have him serve a portion or the full amount of his original sentence. If your brother is on probation have him check with an attorney and his probation officer. Two opinions are better than just one and get something in writting.

By leaving the state he may find himself in jail for violating probation which would be a lot worse than what he is dealing with now.

It is up to the probation officer if he can leave and he would have to transfer his probation and report within a limited amount of time to his new PO.

I hope your brother gets the help he needs.

Well, your not suppose to leave a state while on probation. You can get it transferred. Every state is different. Your brother should contact his probation agent and ask about getting it transferred.

It will be up to your probation officer and department , you will have to request permission for the transfer before you move.

They will get an ok from the area you want to move to, and then they have to ok it also. It is possible, but you will have to show them that you have a job there, a place to live and so on

Dude...Tell him DO NOT LEAVE> This will haunt him and catch up to him. He needs to finish his probation or make arrangements with the probation department. I did something similar and it was all good and forgotten and 20 years later took a trip over seas and when I came back it bit me in the as s big time. Trust me he needs to talk to his PO and they will let him go. Good Luck to your brother in this situation.
