a person who does everthing around the house, doesnt smoke or drink, is with the child 80-90 percent of the time since they were born, actually does things outside the home with the child.
or...
A person who smokes,was beaten as a child and still has issues with it,doesnt do anyhousework, works out of town ALOT, rarely plans things to do outside the house...who would pick and who do you think te courts would choose?

Honestly who ever has a job to support the child. the smoking (as long as its cigs) will not even be an issue the courts don't care about that and it wasn't the persons fault that they were beat as a child so that wouldn't play in effect either as far as housework working out of town etc. they would probably assign someone to check out both sides of the story and the homes on issues like that.

well I would pick the first one, because that describes me the best. When I was young I was scared straight by D.A.R.E about drinking and the last sip of alcohol I had was at my wedding. Before my wedding my father gave me a beer and I took a sip and didn't like it. Sounds like you have a husband that has issues or a friend. The smoking will help you in the court because it is a major concern. They would probably do joint custody, because the person will say they are changed, when they really aren't. I would make my defense very strong against this person.

I would pick the one that is right for the child. Where the child will be safe and have all of it's needs meet. Sounds like the first person would be the right choice. But we don't have all the facts. Just remember it's for the good of the child, not who "wins"

Sweetheart....this question is a given....obviously in the way that you described these 2 people the only reasonable answer is the first one...Seems like what you are looking for is for someone to tell you that you are better than the other parent...Well take a look at yourself...are you a better parent? You are the only one that knows babe. Asking a question like that is just silly.

It would be like me asking you ...what would you rather have for dinner....a turkey with all the fixins...mashed potatoes, stuffing, gravy, yams, squash, cranberry sauce.......and pumpkin pie for dessert.......or cold spam, reheated french fries and freezer burnt ice cream?

The first answer is the obvious best choice (unless you absolutly don't like these items in which case starving might be better than option 2)

You must be a good parent. That is how you portray your self in the question....

Keep your chin up...if things are truly as you described you will win!

The fact that a person was beaten should not matter unless the person is an unstable parent.

Regardless of that, the courts usually award the mother, unless she is unstable, physical custody but both parents usually get joint custody.

I personally would choose the first person.

The courts would choose the mother even if they are like the second scenario.

Sadly many children get put with bad mothers because courts believe it is the better situation.

Well I'd say the 1st, BUT there's usually more than 2 sides to a story. That's the judge's job to figure the truth let is in between.

i would say the first person would be good for the child and the one that knows whats best for the child it doesn't matter who wins has long as the child intrest are met properly.

I think we're getting spin, not the actual story. however, as to your question, the courts even today favor the mother in custody cases unless there is PROVEN abuse by the mother. so if you want the kids, you have them
