The "best interests of the child(ren)" are what decides custody- in Michigan, there are 12 points the court considers in determining the best interests, and you can call the Friend of the Court to find your state's guidelines.
The biggest factor in a custody case is USUALLY "who does the work?"
who is the primary care giver? who prepares the food? who takes care of the sick child? who goes to parent-teacher conferences? This is why custody generally goes to the moms, because we do waaaayyy more than 50% of the work of childrearing.

Child custody battles sadly happens when one parent believes that they can provide for the child better than the other parent.
The importance of what is in the best interest of the child is almost disreguarded by one of the two as irrelivant, sadly, because the child is young, but this is only selfishness on this parent's part.
A child needs both parents and joint custody should be saught not sole custody, which usually only leads to frustration, bad feelings and sole custody should only be saught for the child if the other parent is a threat to the child, or the other parent's lifestyle poses a potentially threatening environment, partying, strangers in household, drinking, drug abuse etc these are some of the potentially harmful behavior that may be considered, as well as child abuse, spanking to the point of marking the child etc.
Wanting full custody of a child for the sole purpose of defiance or revenge or spite is childish and not in the best interest of any child and usually is very visible by professionals and will be used against you in a court of law.

i work at a law firm as a legal secretary and i see crazy custody battles all the time. custody battles are hectic....especially when the person who really deserves custody doesnt get custody. ive seen one case recently where the father petitioned for custody of the child and he was a convicted felon, on drugs, and had an anger management problem....he had a really good attorney....but luckily he lost.

i did not have a battle me an my ex agreed 100% on the agreement he has them on weekends and we both have them for half the day on hoildays.

Well, a couple of loser parents fight each other for a kid niether of them want, but they each want to beat the other in something so they pay the lawyers to battle for the kid.
