i just found out I have a warrant for my arrest for assault 1st degree. 2 days ago i got in sort of a heated wrestling match with my brother when i went to my mother's house (she was not home, just me and my brother). He came at me first with closed fists and I wrestled him to the ground. I never hit him with a closed fist nor did I initiate it.
So anyway, i left and apparently after i was gone he called the cops to report me as assaulting him. So what should I do now to handle this as painlessly as possible (i.e. not having to sit in a cell for any extended time, not having to pay bail) because I have classes I can't miss.
-appear before a judge to answer the warrant, try to get it lifted
-surrender at the station to officers and tell my side, speak perhaps to the officer who got the warrant, tell what occurred (thus admitting we had physical contact) and hope they believe and don't pursue charges
-dont admit to anything (even being there) before i talk to a lawyer

ram - i never did receive the warrant. I found out from my mom. I am following up in a timely matter, the warrant was issued without me ever knowing anything bout the cops getting involved.

man Wanda for someone who has so much against cops and thinks you can get around anything you never give up your Miranda rights that's the dumbest thing you could do! when you are read your rights you keep your mouth shut and say i would like to speak to my lawyer and dint say anything else your slippin Wanda your slippin.

Good Question!
From an officers point of view.
How did you find out about the warrant? Have you spoken to to someone in the warrant division or been contacted by the division reference this issue? Establish it`s validity first!
If there is actually a warrant contact via phone your brother and attempt to reconcile he may have been acting out of the heat of the moment and could possibly drop the charges.
Number two call your Mother and explain the details and ask for her to assist in speaking to your brother to drop the charges.
If this is not working , do you have access to an attorney and have him contact the warrant division to attempt to buffer the issue.
If no attorney, then call the warrant division and explaining you are trying to work issues out with the plaintiff but will come in and set it to work in a time frame that will allow you to do so with your family already notified of the times and have them ready to met the bail so you will not have to have an extended time in jail pending bail. I feel as time allows your brother to cool off he may drop the charges.

The only response to a warrant is to surrender, in a court if possible, so that bail, if any, can be set and you will be able to leave. Best to have a lawyer with you, but the court will assign a public defender for the arraignment and bail hearing if a jail sentence is possible.
As suggested by someone else, have someone ready to post bail if it is required. Bail will probably not be required unless you have defaulted on a warrant in the past.
Lock-up, if they arrest you before you get to surrender, is not pleasant but, depending on where it is, it will probably not be as bad as you think.

Dont worry it is not a serious offence. Have you acknowledged the receipt of warrant? If you have you should appear before the judge on the date mentioned in the warrant otherwise you can not escape arrest. Make sure you hire a counsel. Had you followed up the matter properly in time you could have managed to avoid being issued a warrant.

Phone the officer who has the warrant taken out and tell him you would like to speak with him.
Do not get annoyed or shout as this will be seen as aggression, explain your case.
This sort of thing is usually treated as a domestic and rarely goes very far, unless your brother is a d**khead and wants to ruin your life

There is no easy way to do that, best thing to do is contact an attorney and he will instruct you on what to do. Best thing to do with an attorney is syrrender yourself. Cause if you get picked up you go directly to jail.So do it the right way with an attorney. Once you do that youll go to court but maybe not depending on how good your attornry is. You may just get a slap on the wrist, considering the amount of cases the judicial system has. And try to get it off your recoed cause that will effect you later.

Just turn yourself in now. Warrants don't go away. The faster you go in, the better is will be on you and you can tell your side of the story. If you try to hide, they'll view that as you knowing you were guilty.

Most lawyers will give you free advise over the phone for a quick questions. Look for one that has free consultation in the ad. Is it possible your brother would go drop the charge?

If you turn yourself in, you will sit in a cell for a little while. You should line up bail before you go. I would turn myself in, not on friday - sunday, you want to be available to the judge for bail, but that will look better for you. Don't sweat it, jail isn't that bad.
Do get a lawyer.
