The laws vary from state to state and, and in mine the seriousness of the theft (and the jail time that could follow) depends on the dollar amount stolen . It could also vary from company to company; i.e. one store won't prosecute if it's under a certain dollar amount (say, $5.00) while another will want to prosecute if some kid stole a candy bar. It varies.
