I read in newspapers that in the UK, most rape trials collapse in court. Especially if the victim was drunk at the time of incident, the alleged suspect will easily claim that the sex was consent, that the victim had flirted first.

So is it true that most trials of this type collapse? Why the English court doesn't seem to sympathize with the female victims as much as in the divorce cases?

its a sad case that most do and its true if a women is blind drunk she would not be able to recall all that happened to her . but if you think about it there is the fantastic tabloid that love to sensationalise false rape claims made by women out for one thing only money . and they can sell there story thus cheapening the terrible act of rape and make a accusation falsely and walk away with no charge whits the alleged perpetrator is named with out a trial . really this should carry a a mandatory sentence of 5 years without pa roll and it would stop quite soon and then put some credibility into the justice system and give those who do commit the crime a long and hard jail term . and if you rape a child it should be life with no parole

VERY BRIEFLY... yes most do / did collapse. the law has not long changed, and now they have removed the "consent by proxy" type defence.. i mean that NOW if your a girl been flirting all night, and your drunk and you get raped.... the lad has now still legally raped you.... NOW if your drunk or sober, the lad needs to get VERBAL consent a verbal YES......... the fact that you didn't say NO is not an excuse...(as it used to be)
basically, the law has now changed into the woman's favour, but we'll have to see if it makes any difference, as cases still collapse for lots of other reasons (not least the trauma the woman has to go through in PROVING it)
its s**t i know........ i also think that (being ex army) we should use the rape convicts (and a few others) to do things like drive old tanks for us to fire missiles at, and to maybe do attacks on sections, using toy guns, so that the lads in the army have something to fire at that is more realistic.. maybe they could also use the most junior soldiers to practise there first aid on them after they've been shot / then if they live, they can do it again on an other Military Exercise.....(give something back to society)

I'm sorry but I'm seeing a lot of poor answers that are advising you badly.

If you feel that you are a victim of a sexual assault or rape you need to report it to the police, they have specialist staff that are trained to help people at a time when you may feel very vulnerable and upset.

Each case is weighed up on its own merits, obviously as with all crimes (even murder) sometimes there just isn't enough evidence to obtain a conviction or even to take it to court and charge somebody with the crime, but please do not let this put you off reporting it.

None of the decisions are based on sympathy in either family courts or criminal courts. They are based on facts and evidence all within the context of the law by professionals who have strict codes of conduct and high professional and moral standards.

Any decision not to continue with a case is taken only after careful thought and consideration. Sometimes when there is not enough evidence to charge somebody with the crime it can seem very unfair to the victim, however you cannot charge somebody if it cannot pass the evidential tests that are set out by the Judiciary and Home Office.

Even if it makes it to court it may well be dismissed. (94% are dismissed/collapse)

because most of our government is still being run by man. rape victims (women) are put on trial not the rapist.how sad our systems are. by the time the law is finished with victims bringing up any and all of their past, turning and twisting all, what victim or should i say (survivor) would want to endure being raped again by the people who are suppose to be protecting them? i pray that all rape victims (survivors) find solitude in their lives and no matter what, always remember it was NOT their fault.
