you can "date" an older guy regardless of your age.
if you are sleeping together then it is a different matter
age of consent differs from state to state just look up age of consent and your state on yahoo search engine and it should come up

IMO, if you are dating someone significantly older you should be 18. It's a general rule; besides what is someone doing dating a minor? So if he is older than 18, you should be 18 as well. Should being the keyword. If you both are minors then it depends on the factors; such as state rules, etc.
