We live in a small town, and last night my boyfriend was pulled over and given a warning ticket that he had signed without reading. The officer told him that he was pulling him over for the break light being out. The officer wrote it stating that it was for speeding. But also while he was being pulled over the officer ran his record back 20 years till he could find the one accident he did have. Then also proceeded to state that one of our neighbors said that they caught us dumping trash in the apt. dumpsters. (Why would we do that when we pay for our trsh on time since we lived here he said) - We have only lived in this town little less than a year - I feel that we are being harrassed and what can we do? It is our word aginst his. Also note that the officer told him that b/c our insurance card expired that he could give him a ticket for not having a current insurance card. What kind of crap is that anyway. We abide by the law, so why the harassmnt and what can we do? Thanks 4 any help

No, we do not live in the apartment complex. We live on the same street as one. My boyfriend does not have a criminal record. He had a fender bender like 20 years ago. Our insurance is current and the card in the car does not expire for 7 days. The officer said that even though it still showed current, but because it expires in 7 days that he could have given him a ticket for that. (The officer at the time he was pulled over said that he was giving him a warning for the tail lights, and my boyfriend trusting what the cop said - he signed the ticket. This morning when I got up I looked at the warning that the officer had given him and it said it was for speeding. So the officer lied to him and harassed him. We are in Missouri.

Perhaps I'm misunderstanding the question, but if he gave your boyfriend a warning ticket, it was just that, a warning. Police officers give people warnings all the time and they do not go on your record. It's just a way for the officer to be able to tell his superiors that he wasn't backed up in a hole all night long doing nothing. The ticket goes on file just to show that you have been warned about the offense(s) and nothing more. I know this because I'm a LEO and so is my husband. There is nothing for you to do unless you truly feel that the officer mistreated you (your boyfriend) in some way. In that case, call the department and file a formal complaint. The officer's badge number should be on the warning ticket.

exactly what did the cop lie to you about? when police officers run checks on people the resulting query does not tell them about accidents that have occured it tells them a brief criminal history (if any). when they run the information into the NCIC system it pops back with any arrests that have been made, any outstanding warrants etc. Do you live in the apartment? if you live in the apartment complex then you have every right to dump trash in the dumpster UNLESS the apartment complex has certain guidelines on what can and can't be dumped for trash(like furniture etc). it does not sound like harrassment it sounds more like an inconveinence or aggravation. it you were not happy with the way the police was towards you you can call the police department and file a complaint with his supervisor. this does not appear to be serious enough for internal affairs. and as far as your insurance, your state may have a law requiring all vehicles to be properly insured. if the insurance has laped or is expired you very well could have received a ticket. it is a class one misdomeanor in florida for expired or lapsed insurance. you can call your clerk and comptroller for your city or the department of motor vehicles or go to DMV website for your state on the rules of vehicle insurance. your husband should have read the ticket before signing it and disputed it to the officer if he disagreed. once you sign that ticket you are acknowleding it's purpose and validity. as far as the ticket goes, sorry to say but you probably will not win that one in court. good luck. and get a small notebook and write down the date and time and place of every occurance you have with the police and those pesky neighbors if it goes to court a substantial record of incidences may constitute harrassment later. hope I helped

If you were speeding and he gave you a warning ticket for having a tail light out, I would say he was being good to you. You must have a current insurance card in your possession, this is another violation you did not receive a ticket for. If you abide by the law why do you have all these violations.Yes it is your word against his but who do you think the judge is going to believe. I know people that have trash picked up for free and they still put trash in other peoples trash cans because they reached their limit. where would he get this information anyway.

ALWAYS plead NOT GUILTY... let the bored cop explain his suspicions to the judge...

In this situation he will probably forfiet by not showing up. Cops are NOT bound by any law or department policy to tell the truth..

Citizen beware... and know your rights.

Go to the station, file a grievance and request a formal inquiry.

ALWAYS ask for a receipt of your paper
