If you are an American both sides would want to prosecute...
if you are an illegal alien neither side would prosecute!

Mexico, because the death happened on Mexican soil. America could turn the killer over to Mexican Authorities. But I don't think they would. Also the reason the person was shot in Mexico. Depending on the reason and by who. Not good to be in a Mexican jail. That is possibly why , so many illegals are here. They do not want to be in a Mexican jail.

Mexican gangsters shoot across the border all the time,its nothing new to border states.I'm sure some gang
member from the US shoot back too.Its a war zone and the border city's are the crime scenes.Its time to put a halt to this unlawfulness.Build the fence and make it the entire length of the border.Its time to take this nation back from the criminals.

it would be decided between the courts of both countries. Who would finally prosecute and where the shooter goes to jail depends on the circumstnaces of the incident.

The Americans would prosecute you, then it would prove to the Mexicans, and the voting public that the politicians do care. A perfect photo op. during election time.

The greater crime was committed in Mexico all you did in the US was discharge a firearm. So you would be extradited and tried in Mexico. The charge would depend on the condition of the person shot. Mexican jails by the way - suck big time.

in an ideal world, if you were shooting border crossers, neither. But Mexico thinks they have a divine right to everything on this continent, hence the wall protests, so they would try to prosecute.
