Whether or not online poker is illegal in the United States is currently a topic of heated debate in local, state, and federal government bodies. The federal government contends that a 1961 ban on interstate telephone betting also applies to the Internet, but the majority of legal scholars versed in online wagering do not feel that it would hold up in court (the US has never actually tried to apply the 1961 law to an Internet bettor). Some states have laws that explicitly ban all forms of online gambling -- although (to my knowledge) they have never been actually applied to any person.
Here is a summary of what is going on with online gambling in the United States.
1) Prior to the passing of the Unlawful Internet Gambling Enforcement Act of 2006, eleven states had laws on the books that specifically ban all forms of online gambling. These states are: IL, IN, LA, MI, NJ, NV, NY, OR, SD, WA, WI. Online gambling continues to be considered illegal in these states.
2) The Act did nothing to alter, curtail, or extend state laws regarding online gambling. Thus, it did not make online gambling illegal in all states.
3) The Act places restrictions on the financial transactions that occur in connection with online gambling; it restricts electronic fund transfers and the use of credit cards in connection with such wagering. This means that players can no longer make wagers, or collect winnings using electronic fund transfers, credit or debit cards, or some other online payment systems.
In response to the Act, online gambling sites have done one of three things with respect to US-based real-money players:
1) Continue to accept US-based real-money players from all states
2) Accept US-based real-money players from states other than the states in which online gambling is specifically outlawed (meaning no players from the states listed above)
3) Closed their site to all US-based real-money players

They are things that can only be discovered after hundreds and hundreds of trials. And of course, strict restriction needs to be in place. However, because the basis of science is always changing due to new discoveries, we need to also have sympathy to the drug company as well. They are not miracle makers, they only try to make profits by selling something that they "think" might help other people. Imagine the world without antibiotics and other medication, how many people would have to die? If we agree that science can be changed, the drug company might not have an excuse of increasing medication prices because of law suit.Also if we look at any other area that has used the socialist system it has bogged down and failed to live up to its Utopian promise. No system is perfect but open and free market is the best out there.

You aren't breaking any laws by playing. The law isn't targeted at players, but at sites and financial institutions. It is also very vague and doesn't create any new "law." So playing poker is just as legal in the US federally as it was before. All you have to do is play on sites that still allow Americans like these sites http://www.ultimatepokerbankroll.com/article.php/internet-gambling-ban-poker-sites-status and use financial transfer sites like NETeller or Epassporte.
