The jails are too full as it is. The cop had every legal right to take you to jail though. That's definitely an arrestable offence. Reckless driving. I kinda got that myself once upon a time

No you shouldn't be in jail, but they should give you a ticket and then fine you $10.00 for each mile you are over the speed limit, plus court costs and attorney fees and force you to take a driver's safety course, that you also pay for, and then make you do community service in a rehabilitation center where people have been hit by speeders.

Yes you should be. 40 mph over posted speed limit is known as reckless driving and is a misdamenor offense. At least in the state of florida.

In Illinois it is considered Aggravated Speeding and a Class A Misdemeanor, so yes. I love arresting people for that and normally I do unless they were honest, not drinking and apologetic, then I may bump it down a few mph's and give them a ticket, but usually not.

Depends on the state your in......But you should be,

40mph usually means your in a residential or business area where there are PEOPLE walking around! Try being a responsible adult and drive the speed limit, stop at stop signs, use your turn signals and.......put the cell phone down and actually DRIVE! jmho.

No way dude, you probably get a fine of $125 dollars or lesser than that. The only way you could get arrested for it is if you have a history of speeding fines.

normally if everything else is ok, you get a ticket.

But at the court, the judge can sentince you the way he wants.

If you did not have insurnace on your car, of did not have a drivers license, or if the car was stolen,

You should certainly plan on checking bus timetables. Here in NC, that is a mandatory 30 day ban, but probably more.
