My one month son's father signed a declaration of paternity in the hospital when he was born. We live in different houses and the child resides ONLY with me. I have been trying to work things out with the father but I can no longer tolerate his emotional abuse. He had a huge anger episode last night over the phone and I have refused his phone calls. Now he is sending me messages telling me he is going to call the cops on me for "refusing" to let him see his son..and that I am "abducting" his child!! I am scared and unsure what he means. I do not want him in the house..it is just me, my mother, my daughter, and my son. I am alarmed he is going to do something drastic. I have been toying with calling the cops all day but am afraid to piss him off further..any advice would be most appreciated..especially in terms of him telling me he has half the custody! We NEVER agreed on any form of him having custody at all. Please help..thanks.

By the way, he has doing absolutely nothing to support his son monetarily.

first off if you were never married then there is no custody issue, he does not have half custody you are the sole gaurdian of the child, I had the same problem with my daughters father and the courts laughed in his face so to speak. Second get a lawyer anyway if he wants to fight..fight back and third get a restraining order for you AND the child. Don't drive yourself crazy over this lunatic you are only breaking the law by refusing to let him see his son if there is a court order mandating it.

Forget the cop's call a lawyer. Then you find out that since you have the kid all he can do is get his own lawyer you are the one that has all the rights.Right now anyway until go go to court my son just went through this its a sad thing but true if your bf threatens you then the cops can help .My son kids don't even no there mother and she does the same thing all the time get you a lawyer.

alot of lawyers specialize in this sort of thing and give free consultations. If you have concerns about your or the kids safety you may want to file for a temp restraining order. If the abuse is serious contact a battered women's shelter. They should have access to information and resources to help you. Abuse is abuse and no one deserves it.

If you're a scared as you say, stop "toying" with calling the police and do it. Document his abuse and threats. See a lawyer about resolving custody issues.

Joint custody is determined by the courts, not either parent (unless there is no dispute about it). Get a restraining order and don't try to reason with him.

you desperately need a lawyer. If he does get his hands on your child he could very well leave. If he makes any threats towards you or your child get an order of protection

Go to the Police and tell them your story, you should get a restraing order against him if you fear for your lives. You should take him to court to get child support!

You need to a paper that states you have sole gaurdianship of your child.
