As a retailer is it legal for me to put a customers old tires back on if they have a tread depth of 2/32 or less if they are unable to pay for new tires and services upon completion of their vehicle.

I know less than 1/16" is considered unsafe. As I was issued a warning by the Ohio State Highway Patrol and given 72 hours, to correct the problem. But in your case I would consult your insurance and/or a lawyer, as the guy above me suggested.
