Ok so few years back I tried to help a someone out by moving out of my apt. (left lease under my name) and letting them stay and they would pay the rent..I ended up getting screwed and was left with $6,000 of unpaid rent...I am paying this debt the best I could..I settled with the attorneys for $5,000..which I will pay 1,000 a month... since I neglected to pay a month late but only paid $1000 (suppose to be 2,000) they said I defaulted so they jacked up the amount back to its origianl amount which is $6,000 plus court cost..(they have a judgement against me)..I have already paid $4,000 so I sent in a payment of $230 last week (so now I paid a total of $4230.00)..so the girl from the attorneys office called my office..we got your $230.00 where is your thousand dollars I responded I dont have a thousand dollars..can we lower the amount that I have to pay..no she said..then we will proceed..what the heck does that mean..we will proceed..

They will proceed with collection efforts. If there is already a judgment then garnishment is more than likely there next step. If it goes to garnishment, they can only have 25 % of your net earnings. I would figure what that would be. Take your weekly pay after taxes only and multiply it by 25%. For example if you make 300.00 wk after taxes in a garnishment they would only get 75.00 wkly. 300 X 25%=75.00. They have to leave you with 30x the minimum wage. Here in Indiana min. wage is 5.15, so 5.15x30=154.50, they cannot take an amount that would leave you with less than 154.50. If you make an amount close to the 154.50 then you would take your net subtract the 154.50 and that is what they would get. For example if your net was
170.00 - 154.50 = 15.50.
It is kind of hard to explain but that is how it is done.
1000.00 a month is quite a bit, and I am sure that they will get way less if a garnishment was filed.

They are going to sue you for the balance. If you don't have it they will garnish your pay, or maybe force you into bankruptcy. Get an attorney to defend yourself.
