hey guys

OK here goes. I come over to the USA on a HB2 working visa only valid for about 3 months I jumped the visa . I only got it to get into the country Cos i have a boyfriend here in the states We were suppose to get married asap but the lawyer said to wait cos it will be suspicious, My visa expired 8 months ago and still not married. I am getting worried. I hate being illegal and worry all the time. I miss my family and my friends back home. I talk to him about it and still nothing i do love him but i guess i have to take matters into my own hands. So i cant wait for him to marry me to get legal i think he is satisfied about the living arraingments and the fact that i am here now and feel no need for him to get married i think his selfish not to see my point of view in this..
How do i go about a backup plan? how do i get legal myself ? Any advise will be so much appreciated.

Star to looking for better options. He is not into u! Look for a guy who really is willing to help u out! That means marriage. Guys when they are in love they do anything! Do not waist more time with him. Time is very important in this country. WE do not know when laws going to change. Is a bunch of websites there with men looking for a foreign bride. They believe foreign brides are more kind etc. Good luck and do not be a victim! Is not funny at all! Do not loose hope! Some people have negativity so high that they have to look for victims to share their misery!

You are so nonchalant about defrauding the Americans and their immigration control procedures. It is like some game for you, I think. So first game did not work, you are wanting a new game to make yourself legal (and it is your boyfriend that you think is selfish?). Even to an outsider, your mentality is offensive.

You have a choice between (1) going home -- quietly and unnoticed if you can, (2) seeking asylum if you have a reasonable claim to it (but your stated facts suggest you don't) and (3) getting a job in your country's diplomatic service whch, AFAIK, is the only way to pre-empt the draconian US exclusion rules that even marriage (except to a diplomat or an employee of an international organization with diplomatic or quasi-diplomatic rights) does not avoid.

Listen to dognhorsemom. I deal with the arcane, with loopholes, with conflict of laws. She deals with real-life rules for the other 99% of people and cases.

And even when you benefit from a "loophole" sometimes it comes back to bite you: an acquaintance of mine (the brother of a friend) had a green card which he gave up to take a good job with an international organization. Then he gave that up to take a position as Minister in his country's government. Only to die in a terrorist attack while on a state visit with his country's president in 1983. (The president was himself murdered some years later, but that's another story.)

Dump the creep and go home. There is no way that you can become "legal" in the US under the circumstances, and every day you stay there makes it more likely that you will be caught and deported, then barred from re-entering for many years.

It seems he won't marry you because he realizes you're using him. Better go home.
