OK here goes. I come over to the USA on a HB2 working visa only valid for about 3 months I jumped the visa . I only got it to get into the country Cos i have a boyfriend here in the states We were suppose to get married asap but the lawyer said to wait cos it will be suspicious, My visa expired 8 months ago and still not married. I am getting worried. I hate being illegal and worry all the time. I miss my family and my friends back home. I talk to him about it and still nothing i do love him but i guess i have to take matters into my own hands. So i cant wait for him to marry me to get legal i think he is satisfied about the living arraingments and the fact that i am here now and feel no need for him to get married i think his selfish not to see my point of view in this..
How do i go about a backup plan? how do i get legal myself ? Any advise will be so much appreciated.

I would get to an immigration office immediately. It is extremely serious if you get caught with an expired visa. You need to figure out what to do, either get legal or go home. If you aren't married yet, you won't get married any time soon. Also, I don't believe you can get married legally when you aren't legally allowed in the country. Seriously- talk to a lawyer. You made a stupid mistake, but if you don't try to fix it immediately you could get arrested and deported, which could haunt you forever.

If you want to live in the USA legally you need to go see a lawyer that specializes in immigration. As for the living arrangement if you are not married yet chances are he is OK with the current living arrangement and in no hurry to marry you.
If you miss home and family and friends you can always go home for good...
As a red-blooded American I would appreciate you having your paper work to be here legally. Then you can work and pay taxes like the rest of us.
When you live anywhere it is VERY important to be a responsible part of that society, become legal and then work on marriage.

Get off your butt and take care of the problem already! If he cared he would have married you by now. He's a jerk, move on. Contact an immigraton Lawyer to get the ball rolling or go back to where you came from. We have laws in the USA for a reason. It is not okay for you or anyone else to be here illegally.

Go back home sweetie, it's senseless to stay here and continue being afraid. If he loves you that bad he would have already marry you. If he still wants to marry you, he would, but do it the right way or you could get deported otherwise.

Go home. Forget this dude [as if that was easy]. You have family and friends at home, and this dash to marriage will not be working out, which is the only reason you left home in the first place. Find a guy at home and be happy.

If you go to the JP to get married, I'm not sure they will do it b/c you don't have a legal reason to be in the US. You should consult the lawyer as to what to do next because if you get caught, it won't be pretty.

Honey, 99% of marriages happen ONLY because the women says "Marry me or I'm leaving you." ... Since you don't seem to have this option, I'd say you are in a bad way. He probably won't marry you. Plan accordingly.
