I dont know what state you are in but in florida first the biological parent must give up their rights and then you can do the rest yourself. You just go to a legal service and they will supply you with the paperwork which you submit to the courts yourself. They take the stepparent and the yourself into the courtroom and talk to you and the child and if everything goes well they will grant the adoption.
I am telling you this from experience because I adopted my stepdaughter and it was so easy.
But first I believe you must be married.
Keep in mind once he adopts your child he has just as many rights as you do. Meaning if your marriage doesnt work out he can fight for custody and may gain it. I would think very hard before making the move.
And if you do go ahead with it I wish you all the best and hope he enjoys his child as much as I have my daughter.

usually you have to go to the court house and pick up a packet of papers. After you fill out the papers you usually have to pay a filing fee and pay to have an announcement in two different news papers for about a week stating that you are requesting the court to grant an adoption. Then the biological father has i think 30 days to contest the adoption. If he does not then they do a home study usually and a criminal record check then it goes before a judge. If he does contest it is up to him to prove that the adoption would be harmfull to the child wich in most cases is very hard to prove. It is a long process but i wish the best of luck to all of you......

Well I am in Florida and first off the biological father does not have to sign over rights first. Although it does make it easier. Also you do not have to be married although you said Husband. You need to contact a legal service, it is fairly simple and not too costly. I wish you all the best.
