The cop said "im giving you a citation for running a stopsign for 183$ and 4 points on your license, also 1 for reckless driving because it was wet and there was kids around.
The truth was I stoped aobut 10 feet before the stop (an area which he couldnt see) because people were in the way (trick or treating). He just saw me not stop at the sign and run through the intersection.
But he didnt give me anything. He just said Have anice day and left. - nor did i sign any paper (like i did when i got a ticket for speeding once). Did I get a ticket? Will i recieve something like a court apperance in the mail? If so, can i defend it by saying that i didnt recieve a ticket (since I didnt sign anytihng)?

Unless you signed a ticket they have no proof that you did something wrong. They have to have a signed legal document. I would say that you didn't get a ticket and if you receive anything in the mail fight it.

In Ontario, Canada you would have been served with some kind of document telling you when your court date would be or a ticket. In this part of the world you don't have to sign anything when you get a ticket or summons.
By the way, there is an offence for stopping to far away from a stop sign: Stop wrong place. So next time stop again at the right spot (stop line, or where the curb is)

Even though you stopped 10 feet back, you still have to come to a full and complete stop at the stop sign.
In Cali, you have to sign the ticket and take your copy from the officer before they leave. It might be different in your state. I would suggest that you go to the police station for that area, explain the situation, and have the watch commander/watch sergeant check to see if you were actually issued a citation.
P.S. Halloween or not, it is a felony to impersonate a police officer (in this case, impersonation by pretending to issue a citation - if that is what happened) and the police need to know about that as well.

You don't sign anything often when you're ticketed, but they always give you a ticket, so it seems odd. I would just wait and be prepared to receive something in the mail.

The words "Have a nice day" suggest that he decided not to ticket you. Sometimes they arbitrarily decide not to give you a ticket, but they just want to be rude to you. Some of his being rude is in his neglect to tell you what the disposition of your case is, whether you're being issued a ticket for a traffic violation.

Don't worry about it. But drive carefully. Most people don't drive carefully at all. If you just kill one person by accident or injure a person it can impact your life very severely. Drive carefully and attentively at all times - for your own good and everyone else's.

Ok, he must have gotten another call to go somewhere else more importatnt, no he would have taken your drivers licence, wrtten a ticket and had you sign it.

Also think " trick or treat" he could be having some fun with you also.

But it does not matter, if you stop 10 ft back, that is not stoping at the stop line before you go on and that is running the stop sign.

When you get a ticket, you normally don't sign anything, and a court appearance is usually not required (but I'm in NJ, your state may be different).

Go to your municipal office/court and ask if they issued you a ticket. Maybe the cop forgot to give it to you, or decided to bag it. If he forgot to give you the ticket, I believe you are still liable for it.

If you get a lawyer, you may be able to have it dismissed, but that may not be worth the time, money, and effort, unless you have a lot of points already and are in danger of losing your DL for points.

You are off the hook, since there was no actual ticket issued. Your signature on the ticket is acknowledgement that you have received the citation, but since you didn't sign anything, you didn't acknowledge anything. This guy was just giving you a warning ,and harassing you at the same time.

A lot depends on what state/city you live in. In my state/city you can get a ticket from a photograph taken by a camera mounted near the stop sign or from a video camera in the officer car. Did the officer have a camera mounted in his car? Did he video you going through the stop sigh? If you are really concerned about this you should talk to the police, or better yet, consult an attorney. I know, attorneys cost money, but you would know where you stand.

I've been pulled over for this more than once. Never gotten a ticket for it though. They don't take away your license for one moving violation.

It is called abuse of authority, and could be a violation of your civil rights.

However, if you want to take it far with a grievance, you may be honored by getting the ticket he let you go off without...
