My son's father has not paid child support in months and Maryland pulled his license as a result. If he continues to drive and gets a parking ticket or is pulled over for speeding, what can happen to him, considering he is driving without a license AND it was taken for not paying support? I'm not familiar with how strict MD is when it comes to child support and driving laws.

In MD, the MVA will issue a restricted license which alloes the obligor to travel to and from work. If he's caught driving anywhere besides work (or in your example, a speeding ticket), he will receive the speeding ticket AND a ticket for driving under a suspended license. The officer is likely to arrest the obligor just to take him off the road - but he will be released as long as no other warrants exist for him. In traffic court, the obligor will receive a punishment of a fine and/or points assessed. The judge can extend the license suspension (meaning he can still drive to and from work and nowhere else) - the child support matter is completely unrelated to MD's traffic laws.

I'm a cop in Wisconsin and I've seen child support liens on vehicles due to this problem...However, unless there is a warrant issued by the state specifically for failure to support the child, then he will more than likely receieve a ticket for operating a car while suspended or with no license.

In Wisconsin, we have the right to take anyone to jail just to issue a citation but they would be released about an hour later. The warrant for child support would keep him there...We rarely take people to jail to to write a ticket.

i am not sure with md laws but i know tx. First of all he wanted for not paying the child support automatic arrest which in tx is a felony which can land him in jail up to 2 yrs. As far as drive on suspended dl thats a minor traffic infraction but no insurence in the state of tx makes it a class b mistomor which i do think md maybe is the same. so he looking at jail and fines up to 5 grand and the child support he owe u!

Hope i helped!

He can be arrested for driving on a suspended license, but unless a warrant is issued by a judge for the child support issue, that issue will not come up regardless of his suspended status. There must be a warrant for his arrest that states it's for child support issue. Works that way in Wisconsin.

A cop can and will check his license number, and it will show that his license has been suspended. Depending on the law in your state, he can be arrested.

Yes he will be jailed for driving under suspention and they will likely make him pay some childsupport before he is released if he is that far behind.

They should take him right to jail. If he has the means and does not pay they can put him in prison and what fun that would be.
