I am filing for bankruptcy. My wife is not on any of the debt (except for a CC I will be paying and cancelling). We live at the same address. Will her credit cards be cancelled if they are in her name only? Just because the address is the same? Informed answers only please.

As long as you pay off any debt that her name is attached too. If her name is on any credit cards, mortgages, auto loans, etc... she is equally and fully responsible for the repayment of those debts so if you try to have any of them discharged, it could impact her credit scores.

If your wife is not filing bankruptcy then nothing of hers will be affected. Only the people who are filing bankruptcy get reported to the credit bureaus. Her name does not come up automatically just because your married, you have to supply the credit bureaus with a name and social security #. I know this because I have worked at a finance company for 15 years and I have to look at people's credit reports to decide if we are going to finance them or not. I also know this by my personal experience.

Check with a bankruptcy lawyer because it depends on the community property and bankruptcy laws in your state.

i went thru this once when i was married. No, if she is not on anything you are filing bankrupcy on then she is fine. It will not affect her at all because her name is not on anything. It only affects the persons name who's on the debt.

No -but remember that she may be listed as a payee for you mortgage, utilities and and auto loans you have together as well as bank accounts.
