They adjust status to that of a non-immigrant to an immigrant. They can apply to adjust status if they are within the parameters of their initial legal entry. Also you can adjust status even though the alien entered the US illegally but will be petitioned for by an immediate USC relative, providing that the USC is over the age of 21.
Adjustment of status applies to all persons from other countries.
The European who overstayed his initial entry can become legal without having to leave the US. It is called Adjustment of status. Only if they will be petitioned for by an immediate USC relative.
Immediate relative: mother, father, brother, sister grandmother or grandfather, spouse. Children over the age of 21.

They don't. Anyone overstaying a visa is considered illegal. If they do become legal its through the proper channels, meaning USCIS. Paying the proper fees and waiting the proper time.

Okay put it this way I have never met an illegal European when ever I see their visa expire I soon see them going home and very sad. You know how many illegal hispanics I've met? in the hundreds. And those are just the ones who have told me.
