Its not a matter of if you CAN. You can't CHARGE taxes at all. The question is "Are you REQUIRED to COLLECT taxes?" If you do not sell items as a business, you are not required to collect taxes. The buyer MAY be required to pay use tax, but that is their responsibility. If you have a business, you should check with an attorney to make sure you all following all the laws, not just sales tax collection.

No. Only if you have a tax id # and it is sold to someone in Texas, or if you have a physical store in California.
