I was in a car accident and there was no damage or anything so the other driver and I were cool. But the accident just so happened to occur in front of a cop that was just sitting on the street. Can he just go and give me a ticket even though there's no problem? We didn't call him or anything.

Not unless there is a real violation of a statue or law, poor road conditions and other factors can cause accidents as well.

Beyond that he has to have actually been looking at you when the event occured in order to take the stand as a "witness" to the event.

Otherwise the "crime" has no witness with which to prosecute and it is a bogus charge.

Yes. Police Officers do not have to be called to the scene to issue tickets. If your accident was the result of a traffic violation, which would be 99% of the time, and the Officer observed that violation or the Officer collected statements from the other driver that would aide in the prosecution of the violation, then Game-On. What luck that you would have an accident, then on top of that have it right in front of a Police Officer. You should go buy a lottery ticket.

If you were in a car accident, something must have happened. The officer obviously saw you break some type of traffic law and that was why the accident occured, so, yes, he can write you a ticket. Had it been me and there was no damage, I wouldn't have written you one.

Yes, if he saw a violation, he can and should give a ticket. I was speeding and caused no damage but I did it in front of a cop just sitting there....I got a ticket.

If you were in an accident somebody did something wrong.

no, cops cant give you tickets for violating traffic law in plain view of everyone. Even if you have an accident you should be free from ticekts for violating the law. You should call the police cheif and complain and then sue everyone because they violated your civil rights of driving a car.

If the police officer witnessed the accident it is his duty to investigate. If he finds that a traffic violation was committed the person that committed the violation Will get a ticket.

Yes they can. And it has nothing to do with what the two drivers want to do. You comitted an traffic offense in front of a police officer and he cited you for it. By your logic, it would be all right to not stop at a stop sign as long as you don't hit anything, and that's not right.

in some states, if you and the other driver agree to just call it and not blame one another, and there was no damage or injuries, that is legal..most people call the police when cars have been damaged or someone was hurt because they want to decide who really is at fault...if the cop didnt say or do anything, i wouldnt worry about it

Yes he can, if it is determined that a vehicle code violation occured he has every right, and a duty to issue a ticket

Most cities have an ordinance that police need to follow. Failure to reduce speed to avoid an accident is a citation you can get.
