would sincerely appreciate information from any consular officer concerning this issue I am an american citizen my wife has an approved I -130 pending,, i need to return to the USA A.S.P for back surgery can't travel alone and will need after surgery care.... denied because my wife has not a big bank account,,,, and the consular officer said tha marriage papers were invalid,,,, we were married by local government official at the marriage bureau,had it translated and certified ,i provided medical documentation from the local hospital i was admitted to , doctor strongly advised to have this delicate surgery in USA, they (MDs) have limited knowlwedge concerning spinal cord stimulator that i had implanted 3 yrs ago ,,,,,,,WHAT GIVES CONSULAR OFFICIALS ...what option do i have left my upcoming surgery is scheduled for NOV 21 at the Cleveland clinic???? any way of circumventing thanks ,,,, a very pissed off American trying to do it all legit

I am so sorry about your health problems. I can help you clarify some points. Once you file for an immigrant visa, any application for non-immigrant visa will be denied. Basically, an immigrant visa says you want to live in the USA permanently and the core requirement of a non-immigrant visa is ability to prove that you do NOT intend to stay in the USA permanently. By having an approved or just pending I-130, you have already forgone your chance of meeting the requirements for a non-immigrant visa. It's just how it works...

If your I-130 was approved, then your marriage license must be valid and USCIS must have thought so, otherwise IMPOSSIBLE to get the I-130 approved. Maybe there was a misunderstanding when you spoke to the consular officers or you encountered one that is an A.S.S. and is trying to give you a hard time. It would be great if you could find out what he thinks the defect is so you can "correct it".
Did you ask how long is the wait before you are scheduled for an interview? As an immediate relative applicant, it should be only several months but depends on how busy that consulate is at the time...
Contact your congressman and try to get his support so that he can intervene for you to accelerate things. Also ask if they can help advise you in the proces of applying for a "humanitarian B visa" so that your wife can enter the US and be your caregiver during your recovery time. I know for that type of vis ayou need to provide documentation that your surgery is not possible or recommendable in the country you are in and that there is no one else that can provide you care at home and your health insurance will not pay for a 24 hr nurse and you can not care for yourself. So you will need the help of your doctors and health insurance to show this. Good luck

The case agent will have all previous immigration related records at his/her disposal. If the prospective immigrant has any negative immigration or criminal background, then they will probably deny the application. Simply applying for a non-immigrant visa and then applying for an immigrant visa is, by itself, not derogatory.

I can not answer your question , but I am in almost the same predicament and I don't know what to do either, you said they didn't think your marriage is valid , ask why and what needs to be done to validate it, Or do you feel some one in immigration is trying to mess with you, and if so why, Surely there is something that can be done such as going to a higher official or going to court, I hope you luck and will he;p if I can you can contact me thru yahoo, good luck

if you got married out side the usa then basically you are buggered........as the wife of a usa citizen we was told that once I moved here to live then under NO circumstances to leave as all the papers would be invalid and we would have to start once again paying once again................

American's do not need more medical bills, stay home, u r illegal and do not belong!
