My 12 yr old daughter was pushed, so she pushed the girl back then spit on her. The "assulted" girl said my daughter kicked her many times. A few days later a boy confessed to being the one who kicked the assulted girl --- the women cop was there when he confessed. The women cop said my daughter still needs to take the YAP program.
Why does she still need to take this program if she wasn't the one who was kicking this girl, and the girl pushed my daughter first? Both girls are 12 years old, and we live in Pa.

Run away.... I want to teach my daughter to stand up for herself. It's not going on her record, or through the Jev. court. Is it the police department making her take this program or is it the mother of the "assulted" girl. Why doesn't the "assulted" girl have to take this program - she pushed my daughter first?

Oh yes my daughter is still grounded for spitting on the girl - it's gross. As of date her grounding has so far been a little over a week.
I think by making her take this program is teaching her that it's not all right to defend herself.
She has NEVER been in this kind of trouble before. Has never been in a fist fight - this is a one time happening.

The legal problem is one thing, but does not amount to much. Now the spitting part, that would get more punishment from me as a parent than the "fighting". To allow someone to spit on another is disgusting. My 12 year old would be serving quite a little sentence locked up in her room for that alone. She needs to stop that now before she spits on the wrong person and it ends up a lot worse than what just happened.

I grew in PA but now live in Texas. Most juvenile laws are similar. #1 none of this will show up when she is an adult so do not worry about that.
#2.) Although we seek justice and the truth the facts are that these are 12 year olds fighting and the juvenile court will err on the safe side by asking that she enroll in the YAP program.
#3) Our system is nt perfect and the judge need to make a decision. You can complain and fight this and probably get no where with it or you can set an example to your daughter that you stand by the court and she needs to learn not to spit, etc.
#4.) I understand she was, defending" herself and in the adult world would not get punished but juvenile law is totally different.

Cops are not Judges therefore does not have the authority to make your Daughter go to YAP! The only one that can order that is a Judge in a court of law if your Daughter was found to be guilty. If the Female officer was there when the boy confessed then she will have to uphold her part of the law and come fourth with that information. The spitting part of this situation is yes Assault therefore putting herself in that position to attend YAP! For the assaulted girl she would have to be found guilty as well in front of a Judge. The Judge will probably have all 3 attend YAP! It's great that you have punished her for it shows her she did wrong but commend her for standing up for herself. I agree with your daughter defending herself by pushing back, but the spitting is a problem. I hope you explained to her that spitting on someone isn't part of instinctively defending ones self.
The officer probably looks at it this way....Make her go thru the program at 12 and it may stick in her head, thus avoiding future problems.
You may have to bite your lip....but go with the officer on this one. If you openly back your daughter she may develop a "my mom thinks I'm right and the cops are wrong" attitude.

You just used it yourself: To me it says "I don't really have a good answer for that, so I'll pretend you're too stupid to understand." or "I don't actually know the answer for that, so I'll pretend you wouldn't understand it anyway." I have used that answer when I have answered a question by a person I've answered before and I know what they think because they've said it (probably multiple times) BUT I need to provide correct information to other people who will be reading the replies to the post. It is a very common situation. An example: There is a complete idiot who insists that the Catholic Church will not let you get married if you can't have children.

The woman cop is not the judge. When you go to court explain "everything" to the judge. This sounds like total reaction on your daughters part. Also bring with you a written letter from your daughter to the girl and ask for one in return.

She pushed back, in many states even if pushed, or hit you are suppose to run away, not fight back, if you do fight, even to protect yourself you can still be charged
Also it is not up to a cop to decide what she has to do or does not have to do, ( unless they are doing this though the department so no record will show up)
but a juv judge would have to hear the case and order any sentence.

Cops have no authority to render punishment. They can do certain things to a juvenile that they cannot do to an adult, but this is not one of them. If you feel that your daughter was singled out, talk to the cop and explain the situation. Inform the officer that they don't have the authority to do what they demanded.

If all they did was push eachother then i could see your arguement. The issue is that spitting can carry diseases such as AIDS and HIV which is a death sentence. It is not unususal anymore to see a child with HIV or AIDs
