he annoys everyone in the house and keeps us up til after midnite.no sugar, no caffeine, but i can't think of why he does this

ADHD, get him checked out for it.
ADHD kicks in around 11 pm (evening time), and we can stay up all night long!
Not all kids with ADHD are bad kids, ADHD kids are VERY smart kids! With the correct home life (which sounds like this kid has) can be very productive members of society!

My daughter is 8 and is the same way...very smart...after school activities...very hyper after 9pm. That was until we changed her diet. We no longer eat canned foods, buy frozen or fresh. We stay away from sodas after 2pm and processed sugers (hard candies) as much as possible. We have a normal wind down routine at bed time. Since we started all of these things, she has calmed down a lot.
Not all hyper children have ADHD, some are just more active than others.
Though, you did not mention if he likes to sleep in late. If he does, his 'clock' just might be set to staying up late and sleeping in. If so, it will be much harder to change. Keep bed times and morning times as routine as possible.

Are you 100% sure he isnt eating/drinking things with hidden sugar/caffeine? Unless it a fruit, veggie, or otherwise unprocessed food then it could have sugar/caffeine in it. I just found out that Sunkist has caffeine in it!

Probably all the hormones he is developing and doesn't know what to do with them. Has he always been this way, or is this a recent development? If it is recent, you need to keep your eyes open.
