I was in a auto accident and the other party came from a side road across two lanes and hit me in the middle of a four-lane hwy. I called a attorney and he had me sign a paper for i/3 of my money and when I needed him he told me there were no laws to help me and he couldn't do anything to help me get the medical help I needed. That there was no law that said the ins company had to give me anything.

I think you left some information out. Are you talking about getting your medical bills paid? The other insurance company doesn't do that. You have to claim that with your own auto coverage, if you carry it to pay for your bills, or your health insurance. Your bodily injury claim is settled at the end of your treatment for your pain and suffering. That's when your attorney will be a BIG help!

First you need to notify your insurance company of this accident. You do this through your agent. The other party may sue you, even if you are not at fault, so you need to give your insurance company notice.

Next, you need to determine if you are in a no-fault state. Just ask your agent. It is a yes or no question.

If you are in a no-fault state, then you file a claim with your agent for your medical injuries, to be paid by your auto insurance company.

If you are not in a no-fault state, then I agree with your lawyer that there is no law that says YOUR auto insurance company has to give you anything. However, your lawyer should be helping you file a claim against the other party's insurance company.

If you have health insurance, you can file a claim with that company too.

He's absolutely right! Most states now require "serious injury" to file lawsuits involving auto accidents. Whiplash, sprains and strains, small cuts and bruises aren't worth diddly these days! You can thank your politicians for that! While they sit back and fill their pockets with kick back for election coffers and all their other luxury needs, we pay the price all the way around with higher premiums, pain and suffering, and huge financial losses! This is what "republicans" are all about! All corporate America and screw the citizens!!!

Its all about ergonomics and the correct placement of the headrest, if more people were educated we would prevent more whiplash injuries.

you went to the wrong lawyer. call around and get references for another lawyer. go after both the other drivers insurance and that incompetent lawyer hurry you have limited time to file your suit..
