You need to talk to a proper immigration advisor, maybe a Law Centre. As I understand it, when you apply for indefinite, they will ask if the marriage is still "subsisting". If you're not living together, you wouldn't get stay - if you lied about it, and they catch you out (but need they?) any stay you got could be revoked.
Actually, if you really love each other, what's more important is that you work this marriage out. There's many people that got stay here, after years and years they ended up regretting leaving their country. So don't concentrate just on the papers if there's a chance to make a happy life with the lady.
Best of luck

I am sorry that is happening to you.
Whether you will be able to apply for the Indefinite Leave to Remain depends on why you broke up, if indeed you guys break up now. Most of the time, if your marriage breaks down within the 2 year provisional period, you will lose the right to apply for it. However if it breaks down due to special circumstances such as domestic violence towards you, then you can still apply, but you have to prove that it was because of that. So in your case, I doubt it.
The other ways to apply for Leave to Remain Indefinite are:
In the end of 4 years work permit or HSMP. But that means you have to get work permit or HSMP visa first, and it is very difficult.
Also you can apply after you have stayed in UK for 10 years legally (includes student visa) or 14 years legally and illegally mixed.
I suggest you to speak to an immigration lawyer about it, as they know the best. You can find many adverts on TNT magazines or its website. It is worth checking Home Office's web site, but avoid talking to Home Office or UK Visa/IND, because although they are the ones to deal with the application, they do not always know what to advice. They tell you one thing, and after a week or so someone else picks up the phone and tells you a completely different thing.
Mean while, try working things out with her. If you guys talk through it, maybe you can find a way out of your problem.
Good luck.

That is tricky. But, hopefully you can try to make the marriage work. If you do split up ,chances are that unless you have been in the country for more than 3-5 years, you may have some difficulty obtaining a permanent visa. HTH.

If it really goes pear shaped, speak to your solicitor. He/she can probably start proceedings for your indefinite before the decree absolute is finalised, and also help with divorce proceedings if it comes to that.
The other option is to show ur wife that you really love her and let her go without ur indefinite.
Could also check the homeoffice website for help in special cases.
Hope it helps.

I think I'm correct in saying that if your residency permit expires before any divorce, then your permit will be renewed but after any divorce, you will no longer have the "right of abode" and it will be withdrawn. You will not normally be allowed to renew it unless you have children.

This will affect your ILR since you have been resident in the country for a prolonged period and were married to a british citizen.

if your marriage breaks up, u have to leave the country as the reason for your visa no longer exists. you are not eligible for indefinite leave to remain.
