Good heavens! That dog is well equipped to handle much colder temperatures than 40 degrees F..
I wouldnt worry till it gets 20 degrees below.
Forty degrees may seem cold and cruel to you but your dog can handle it.
Nice to see the sentiment though. You're a caring and respectful owner and should be commended as such.

Unless the dog is a sled dog I prefer to let the dog choose for itself how long it wishes to stay outside. When my dog (Black Lab) is let out he knows that all he has to do is ask to be let in and someone WILL open the door. It's ZERO F degrees here today and he has been out 2-1/2 hours. I just checked on him and he is asleep up against the back door. He didn't even raise his head when I tapped on the door. And my cats have been gone since 7:00 AM this morning. They won't be back before 2:00 PM. So, how long realistically; that depends on the dog and the circumstances. I know of farm dogs that never come inside; they bed down in sheds or barns. A small dog with a short coat might refuse to go out altogether, and chose to do it's 'business' at the door. The dog you describe in your question is being abused; he has no say in the matter and he has no shelter. Someone doesn't deserve to own that poor creature. The odds are that the dog can survive this treatment - but he will be miserable and uncomfortable.

An Akita should be able to stay outside at 40* . When you bring him in, crate him. If you don't have one, get one big enough for him to stand up, turn around and lay down in. If you haven't crate trained him, do so. There are websites to explain how to do that. Please read the information. I have 2 Boxers that are crate trained (one came that way and the other was taught) and it is wonderful. That is their den and they love it. They take their naps in the crate and sleep in them at night. They both have crate pads that are soft to lay on.
He may decide to fight the crate, but keep training and don't give in. You are his alpha leader and he will soon learn that.

How cold outside do you is before you want to come in and get warm? They tell you when it is freezing bring your dogs or any animals in.

IF HE HAS A HOUSE, HE'LL BE FINE TO ABOUT 20 DEGREES. I WOULD SUGGEST CRATING HIM IN THE HOUSE AT NIGHT IF YOUR NOT SURE.
