My son got attacked by a Great Dane. He was playin ball with a friend. The dog jumped the fence and attacked him. The owner of the dog was renting a house which was owned by her parents. The owner of the dog moved to another location. She left the dog for her parents to take of until she got settled into her new house. Can I file a claim against her parents homeowners inc. even though they wasnt the owner of the dog? The owner of the dog doesnt have any type of inc.

You certainly can do that. The resident, who allowed the dog to live there is responsible..They acepted the responsibility when they allowed the dog to reside there.. I hope your son will be OK..
I used to board animals, and I was responsible for any damage they might have caused..

I am assuming the owner can provide records of the dogs vaccinations and rabies being up to date. First and for most is your sons health. He should be seen by your family physician who has to by law report all animal attacks if the person has bite wounds. From there if the owner or you feel there is possiable risk of a repeat attack the dog should be euthanised. From there your vet has to fill out a form and have the dog checked for rabies. The only way to test for rabies is the dog has to be put down first.
If the attack has cost alot in medical bills and other treatment for your son at your own expense, then yes you can file a claim but they are going to want proof of doctor's visits etc as well as the medical history on the dog. they are just not going to give you money with out doing a full check and report. Be ready to be in for at least 6- 8 months at the soonest before reaching a settlement.

yes you can sue the owners of the house, assuming your son was injured take pictures of the injuries this will come in handy should the insurance company bulk on paying the hospital bills, make a police report, even if your son wasn't seriously injured this may happen to someone else and the attack will be on record.hope your son is OK and I hope this doesn't ruin him for having dogs around him, I know it scared him but not all dogs are bad (there is no such thing as bad dogs~only irresponsible owners) Good Luck~

Yes you can my daughter was attacked by her babysitters dog and I filed a suit on the parents cause they owned the house and yes the insurance company wanted to settle but i took it to court for the fact the lady that was baby sitting my daughter didnt even bother calling me at work to tell me and when my husband come from off the road driving a truck he was about to go get our daughter and the baby sitter sent her home and got in to her car and left and then they moved out in the middle of the night so she wouldnt have to be confronted by me or my husband or the police,,, did you file a police report and get aspca involved cause that is the best way to go about it also i wasnt going to get them involved and i was advised to call both the police and the Aspca cause the dog might need to be cornteened for 10 days to see if it has any disease that could affect your son... The first thing I would do is seek medical attention for your son assuming he needs it. You didn't mention if he was injured or not.
I would also file a police report, and contact the local Humane Society.

You want everything documented for future use. I'm assuming you have medical expenses. If not, just make sure the dog has all the proper shots etc.

First of all, did you call the police? They should be called immediately to file a report. They should be able to tell you what to do next. You definitely have a legal case, I'd call your lawyer too.

call animal control, the cops, or sue. don't shoot the dog, (i would want to), cuz then the owner can sue YOU.
