They made an error with regard to a payment many months ago. I found this error while attempting to purchase a new home. I have spent many cell minutes, work hours, and sleepless nites attempting to resolve this. After speaking with 12 manangers, I am being told that there is nothing further they can do. I need to talk to someone higher in this stupid corporation other than an account manager. Any suggestions?

If it's on your credit report, I'd file a grievance with the three credit bureaus - Experian, Transunion and Equifax

I'd begin by requesting your free credit report here: https://www.annualcreditreport.com/cra/index.jsp

Here is some additional info from a consumer advocate:
- You have the right under federal law to challenge items on your credit report. The credit bureau then has 30 days to decide whether that item should be removed.
- If a credit bureau refuses to correct a mistake, you can sue.
- Get copies of all three credit reports six months before you apply for a home loan. An error on your credit report can take months to clear up.

Lets take the easy route first and see if this works.

Call up a manager at cicimortgage. Inform them that they are knowingly posting inaccurate information on your credit report. Remind them that by doing so, they are violating the Fair Credit Reporting Act, and this report is causing you to have difficulty in getting a new mortgage. By law, they could be held liable not only for damages being caused by this report, but can also be sued for $1000 in punititive damages.

If that doesn't work, then start the dispute process.

1) Send a dispute letter to the credit bureau. Point out the error and give any documents and info you have to prove it.

2) Send a demand to validate letter to Citymortgage. Send them these same documents. Demand that they provide you with evidence that the information being provided to the credit burear is accurate.

3) If they don't respond back, or don't remove this listing, follow through on your threat and file a small claims suit against them.

We had the same problem with Washington Mutual. All you can do is explain this to your prospective mortgage company and they will probably have you write a letter to the underwriter explaining what is going on. You can go directly to the credit agency that is reporting this false info and dispute it...they have to contact the citimortgage and Citimortgage has to be able to prove it is correct or legally the credit agency has to remove it. If they are saying they are wrong MAKE them send you a letter. You can send them a certified/return receipt letter telling them to remove the mistake. It would be best if you can prove any of this to take the paperwork to your prospect mortgage company and let them copy all your backup...they should be willing to work with you or maybe you should find a different mortgage company!

If you have proof that it is in error then dispute it with the credit reporting companies as you have been explained by others. IF THEY FAIL TO CORRECT the error and you are denied credit based on their reporting then you can sue for up to 3 times the amount of credit lost and of course go for punitive damages. IT IS Called THE FAIR CREDIT REPORTING ACT. Go up the food chain in the bank and fax the proof to them they must change their reporting. When speaking of a mortgage then any good atty will take this case as it is generally big $$$. You will need a statement of credit denial from your loan officer with the appropriate boxes checked and signed and dated in order to proceed with a suite.

First file a complaint with the better business bureau. Then find yourself a good lawyer!!!! I too have dealt with them...and they see no one Else's side but their own...
