I have custody of her and I have her ss card, but he knows the #. Can he go behind my back and take credit for her?

I have full custody and my ex can't claim our child unless I sign a paper giving him permission. Which of course I don't. He tried to get me to sign one time that is how I found out he had to have my permission. You can call one of the tax preparers in your area and ask them. When I have had a question before tax time, I would call H&R Block and got an answer without costing anything.

Only one of you can claim your daughter on thier taxes. He can show child support payments, but not claim the deduction. Only the custodial parent is entitled to the deduction.

What percentage of the baby's support do you pay? Document it. That and the fact that you have physical custody are what counts. If he claims her and gets audited, that's his problem. Keep your tax documents for 7 years.

if he tries to take credit for her you have the proof that she is in your custody ... he'll be the one to get in trouble for falsifying applications & reports, make sure you have everything documented (like who has full custody & all)

you will have to find a lawyer that can help you with this one, he has no right to take credit for her if you have custody of her.

you mean claim her on his taxes? I think he has to prove that he either has legal custody of her or pays child support.

besides, doesn't really affect you if he does, since you are (presumably) filing separately and can claim her as your dependant.

He can, but if the government catches him he will be in trouble since you have custody.

Not by law. You are the sole provider so he is claiming her for his own selfish needs you need to speak with a lawyer.

sure,, but the IRS will nail you or him, you need it in writing,, doesnt matter who has custody until the IRS catches up to you,

Not legally. If he does claim her & the IRS catches him he will be in big trouble.
