PLEASE no rude answers!! I'm asking this question because we want to do the right thing and make a better life for our family. We live in WA state. My husband has had 3 DUI's, and one simple assault charge, plus a long time ago had a minor in posession of alcohol charge. He came here illegally from Mexico when he was 15. He is 27 now. He has never been "deported" but he has been sent back to Mexico about 2 times, and is in the process of being sent back again. He always signed the paper to go willingly. We have a 14 month old daughter who really needs him in her life. We are married and I am a U.S. citizen, born here in the U.S. Is there any way that eventually he would be able to be here legally?? How would I go about the process? Are there any groups that take on cases like this for free? We don't have a lot of money for lawyers, etc. Can anyone help??

Please only answer if you have real facts! A lot of people think that since we're married he should automatically become a U.S. citizen, and that is far from true!!

Try Catholic charities. They have a service called Catholic Immigration that you can get help from at no or reduced cost.
Check with your local Catholic Church for the number to get in touch with them. (I would call a church that offers mass in Spanish so they will know what you are talking about.)

Your best source of information is the INS itself. He should be able to get a green card since he is married to a US citizen, but you'll need to check the procedures to see how to get him one.
Do a search for Immigration and Naturalization Service on the internet. The official site will have a .gov extension. While there, do a search for foreign nationals married to US citizens.
You do not need a lawyer at this point. Just follow the regulations.

Wow! Your case is really complicated. For my husband I know that a background check from both the US & Mexico were required for him as well as an FBI fingerprint check. He had no criminal record so we didn't have to deal with any of that and it was still complicated for us. Check with the Catholic church (if you or your fiance are Catholic). I know they have an organization just for helping immigrants but I can't remember the name of it. You can find it online. Maybe they can offer some advice on what to do. There is also an organization called "Bridging the Gap" that I found online that was very helpful to me. I did all of my husband's paperwork myself through forms I downloaded online throught the INS website. There is a lot of helpful information there.

The first thing you have to do is ask for his petition it ain't going to be easy since he has had 3-DUI's that will stay on record for 10-yrs! my only recommendation for you is to go to this web-site:

then go into search and type in Immigration and they will be able to help you I think they have lawyers there that help for free I'm not very sure but they helped out my uncle there!

If your Married he should be able to stay... cant he? I dont know the law but thats how I understood things went. Anyway to answer your question, no he wont be allowed to become a citizen. But dont worry he will be back ;) the government cant keep us down.

Marry him, and he should be able to be here legally, register him as your husband etc. and he is than in the States legally, simple as. Just tell immigration offices as he arrives at the airport etc. and tell them that you are married, show your documents and things should be going alright. GOOD LUCK!

Immigration will do criminal check background on your husband. Good luck if he's given a chance to become a legal here in the States.

Try going back to his home country and going thru the paper work to be here legally. And try not to drink and drive. Next time he may kill someone.

I can tell you right now 100% he will not ever be a legal citizen in America! He should have tried legally the first time - as for having a child involved is irresponsible on both of your behalfs.
