Sure you can sue, but you might not win!! Even if you win, depending on the local laws, you might not have any way to get the $$ back from the minor.

The big problem is, the lender has an obligation to take reasonable measures to be sure the other party is who & what they say - and in some places, the minor is NOT of legal contract age.

It's not going to be an insured loss.
