You didn't blow the breathalyzer? Why? If you refused you can kiss your driver's license goodbye - possibly until you are 21.
Of course you can fight it; but if it's your second offense, the judge is not going to be very disposed towards you and your attorney. Everyone else has already said the right stuff about learning from this, so I won't add to it. I just hope you aren't driving in my state.

Usually a refusal to blow is an assumption of guilt. If they have evidence from the arresting officer, you will still be charged.
Second offense means something should probably be sending you signals about what's going on with you.

The correct answer here is "yes". You can fight any charge or arrest as you are held innocent until proven quilty by a court of law. The only problem is some charges are eaiser to be found not guilty on than others, and yours is probably not one of the easy ones..

It does not matter if you took a breathalyzer or not. If the police can prove you consumed alcohol, they smelled it on your breath, you failed sobriety test, etc... you can be charged.
