Hi there
I need some information, I did some thing wrong in wal mart and they called police then they charged me with trespass now I can`t go over there and all of the wal-marts for one whole year I came hear for less than 1 year and now I want to apply for job and college , just I will be appreciate if you give me some information about this matter the theft amount it was $5.00 and i have to tell you that I did`nt pay any fine ( maybe they did not charge me ) just i am so upset and i want to make sure about my records.

I will be appreciate if you tell me what should i do ?

If you didn't pay a fine, did you sign any sort of court document? Did you even go to a court? Did the police book you (fingerprints, photograph, etc.)? If not, you probably weren't arrested but rather warned against "trespassing" in Wal Mart. Best bet is to check with an attorney familiar with the police department involved, like from the same town or county. Or check with whatever court you went to.

Wal-mart, and all other stores, are private property. They have the legal right to bar anyone from their stores for nearly any reason. As long as you have been informed that you a barred, you can be charged with criminal trespassing if you enter any of their stores. As far as a criminal record is concerned, if you never went to court, you don't have a criminal record. Even if you confessed, a judge would have had to sentence you.

Walmart trespasses EVERYONE for one year who shoplifts from their stores. Even if it was only $5.00. If you signed the trespass admonishment and you go to Walmart within that year, you can be arrested for criminal trespass. Being charged with a crime and being trespassed from a location are two different things.

in Texas under $50.00 is a class c misdemeanor which means you will have to appear in court and pay a fine. if an officer advised you that you were on criminal tresspass you better not show up in that wal mart.

If you were under 18 I don't believe you need to reveal any $5 crime. I know someone who was banned from WalMart for stealing when they were young. He's been there a million times over.
