Let me explain the situation. A month ago, I bought a watch from a little store in my local mall. I had 30 days to return it and I came back a week before the 30 days. The lady wouldn't let me return it because she said the card I gave her to credit amount back wasn't the same as the one I had to used to purchase the item. Well, my mom had gotten our credit cards upgraded and she cut up our old ones. The lady also said that since I came in before the 30 days was up, I could return it at any time. I tried to get that in writing but she said she wasn't allowed to sign anything. She is also the manager by the way. So, I had a good friend of mine call her top boss and he agreed to issue me a refund. I went back yesterday and the manager wasn't there and she won't be back till Tuesday which is past my 30 day period. Do you think she will try anything? Do you think if I go in on Tuesday she will just say it's past the 30 days you can't return it?

Please let me also add that this lady had made up every excuse possible to not allow me to return this...she even tried to accuse me of already wearing it.

Alright firstly, this lady could've signed something, she was just covering @ss.
Secondly, what it sounds like is that she possibly gets comission on items she sells and that's why she is unwilling to let you return that watch since she would literally be having money taken out of her paycheck.
As far as the credit card thing goes, normally store policies don't let you put money from one card onto another (even WalMart has that) but that, again, is just a ploy to basically have somebody settle for getting store credit instead of an actual refund. If its at all possible, you can get a hold of the credit card company and have them fax you something saying that the card you have now is the same account as the card number from your reciept.
This girl just seems shady and if she doesn't let you I would make a huge stink in the store, just let it all out, how she's tried everything to get you to not return this watch and mention that corporate said that it would be done. If that doesn't work, right in front of her, call up corporate and explain the situation saying you're in the store now and the "problem person" is right there to talk to if they so wish. It'll work trust me, it seems alittle mean, I know but she deserves it for making you jump through all these hoops for a stupid watch. Don't feel bad, she has it coming!

She will probably return it.. But if she does not...
First call your credit card company,, the one the watch was bought with and tell them you want to dispute the charges and refuse to pay for it. You will hav to fill out why and explain the reasons but you have the right to do that when something is purchased with a credit card.
Second Call your local better business bureau and file a complaint.. You can also do that online at
www.bbb.org
Then finally contact your local Chamber of Commerce, and Small business Association.
Let them know in writing what has occured.
Finally if this is a chain Contact the home office .. and if its privately owned.. Contact the actual owner.. put your complaint in writing.
This person is only a manager.. thats all .. if she does not satisfy you go ove rher head and keep on going util you get your refund!
Good Luck,, and I probably would not do business with this store again.

They are very specific when they sell to anyone that no one can bring it back with out a receipt. They give everyone a regular receipt and a gift receipt, no matter what you buy! I bought a can of formula for my son and they gave me a gift receipt! The person who bought it was obviously well aware of the policy. Plus, they only accept exchanges or returns for 90 days, so I don't know either how long you have had it or if you just received it? They will know that you just barely added it to your registry. Everything computerized is pretty advanced, and they will know exactly what day you added it. I own a small business, and I do not believe this is a crazy return policy! Even though it is exclusive to that store, without a receipt, they know it came from their store, but they don't know if you might have stolen it! Why would they give you money back for something that they don't know if was ever paid for to begin with. I wouldn't do it, but you can take it back to Walmart. I overheard their store policy one day while waiting for my husband and son outside the bathroom in front of Customer Service. They are obligated to take back ANYTHING anyone brings back, even without a receipt, even if it was not purchased there and is nothing they carry. They input the return in the computer and link it to your name, and everyone has 3 returns they are allowed per year with no receipt.

If it's one of those vendor carts in the mall then go to the Mall's main office and speak to the person over the carts. If your mall is owned by Macerich then it will be the Specialty Leasing Manager. If it is owned by Westfield then it is probably someone with a similar title. Either way, I would just go to them if she doesn't refund as promised because those vendors sign agreements with the mall when they rent space and the mall has an interest in your having a good experience there so they will most likely help you out.

There are two things you could do:
1. File a complaint to the Better Business Bureau. They can appoint an arbitrator to solve your problem.
2. File a claim in the small claims court. Most small business don't want to brother with going to court, because it is not going to worth their time and effort.

First, call your credit card company and dispute the charge. This will serve to deprive the merchant of their money rendering them more open to discourse. Second, go in and ask for the refund if they say no your dispute will be negotiated by the credit card company.

tell her your friend talked to HER boss, make sure you give that persons name. Usually if you say you talked to someone higher up they will do just about anything you want. If she still wont return it, let her know you will be contacting her boss again!
