My husband is in H1visa and i am in h4 visa. i am pregnant. we are planning to go to india for 2 weeks during the first week of 6 month and back in the mis of 6 month. i wanted to know if there will be problem at the port of entry when we return to usa.

Please check with INS....Don't rely on answers here....I know when my husband was in the process of getting his green card, it was prohibited....

Yes. By admitting a pregnant woman, the H-4 visa holder would be allowed to give immigration benefits (U.S. Citizenship) to the unborn child of the visa holder.

You are in a tough situation. If you leave the U.S., there will be a definite risk that you will be denied entry. Once that happens, the child will be born in India, and it will be difficult for you to get the child a new Indian passport and a U.S. visa.

However, if the child is born in the United States, he or she will become a U.S. citizen. Once this happens, you and your husband will find it hard to renew you Non Immigrant Visas.

You need to determine your intentions in life and contact a local charity that assists immigrants. The best known one is Catholic Charities.

H1b and H4 visas are dual intent visa (this means that Immigrant intent is OK), so you should not have any problems when coming back from India.

Definately check with the United States Citizenship and Immigration Services. Their info will be more reliable than anyone on here.
I entered the country legally, am waiting to get my status adjusted and to get my green card... and I am stuck here until I have that, or I won't be allowed back into the country if I leave. I haven't seen my family in 2 and a half years, it's painful, but if that is what I need to do to be able to remain with my husband and daughter, that what I will do.
