In most states a vouyer tape is NOT illegal (insane huh) but audio taping them is....(really insane) If the vouyer is not on your property then he can claim that is was made as a surveilance or research tape....our laws need to change. You can tape a woman taking a shower but you cannot tape a stalker calling you on the phone without their permission....click. INSANE...

It depends on where the person was when they were filming.
If they use a long range lens and are not on your property, there is no crime.
