It mainly depends on what state or city you're in. State laws and city ordinances vary greatly. It probably won't matter how far away your house is or what time it is. What WILL matter, is your level of intoxication. Most states have public intoxication laws that basically say you can't be in public while "under the influence" of drugs or alcohol. Just because you've had a couple of drinks and maybe smell like alcohol, doesn't mean you're under the influence. That's what field sobriety tests are for. But remember, you don't have to be "drunk off your a**" as you put it, to be cosidered under the influence either. It all depends on your tolerance for alcohol. The average persons body can metabolize 1 drink per hour. Hope this helps.

Public drunk, they will probably ask you who furnished you with the alcohol. But unless you are carrying an open container they can not charge you with minor in possession of alcohol. If your under 18 you could be taken to your local "CIC" for teenagers that get into trouble. Only the person who furnished you with the alcohol can be charged with child endangerment or contributing to the deliquency of a minor

How far under the age of 21 are you? If you are a teenager you can be charged with JD. If you are 18 it will depend on what laws your city has too deal with that type of violation.

I don't know what the charge is, but there is absolutely no excuse for drinking at any age and especially under age.

You will get a summons to appear for underage drinking. It does not matter that you are not driving.
